近來，歐洲拒絕移民政策，被稱為「民粹主義者抵制自由主義」；美國同樣出現「民主機制倒退」的反思。反觀臺灣的自由度，2018年被「自由之家」整體評比，全被評為「最自由」。臺灣自由化程度的突破與超越，從大法官釋字第748號解釋也可窺知一二。本文旨在析論孫中山民權主義思想，與大法官釋字第748號解釋之要旨。本文首先紹述孫中山民權主義思想之基本論述，包括合理的自由、真正的平等、充分的民權與萬能的政府。其次，從司法院大法官釋字第748號解釋之要旨，進一步歸納出，大法官釋字第748號解釋爭點與理由書。然後，作者析論孫中山民權主義思想，與大法官釋字第748號解釋之要旨。本文發現：同性婚姻為合理的自由範圍，憲法對平等權的保障為真正的平等，大法官釋憲制度展現充分的民權，大法官釋憲制度為萬能政府的體現。

Recently, Europe rejected the immigration policy, which was called “the populist turn and the rejection of liberalism”. The United States also reflected the “Withdrawal from Democratic Institutions”. In contrast to Taiwan's freedom, in 2018, it was rated as "free" by the "Freedom House". i.e., "the most free". The breakthrough and transcendence of Taiwan’s degree of liberalization can also be seen from the interpretation No. 748 from Justices of the Constitutional Court, Judicial Yuan, R.O.C. The main purpose of this article is to access Dr. Sun Yat-sen’s “Thoughts on Political Rights” and the gist of J.Y.Interpretation No.748. First, it will depict the basic exposition of Sun Yat-sen's “Thoughts on Political Rights”, including “Reasonable Freedom”, “True Equality”, “Full Civil Rights” and “All-capable government”. Second, from the gist of the J. Y.Interpretation No. 748, it is further summarized that it explains the holdings and the reasoning. Third, the author analyzes the gist from J.Y.Interpretation No. 748 and Sun Yat-sen's thought of “Ideologies of Political Rights”. Finally, this paper finds that same-sex marriage is a “Reasonable Freedom”, the system of Justices of the Constitutional Court, the constitution's guarantee of equal rights is “True Equality”, Justices of the Constitutional Court, J. Y. Yuan, R.O.C. shows “Full Civil Rights” and the system of Justices of the Constitutional Court is the embodiment of the “All-capable government”.
