題名(英): The Incline Between Powers: A Viewpoint of Legislative Censorship's Impasse

全文內容: 　　立法機關的主要功能，雖在立法、監督與代表性等，然隨著時代的演變，立法功能卻有式微現象，而監督、批評及控制政府，相對更為重要。始自我國戒嚴時期，行政部門常無視於立法審查，往往僭越行事，以主動立法預留自己便宜行事的空間，加上立法審查的怠忽，以致立法權地位低落，身為民意機關而民意支持度低落，官吏知有命令不知有法律，甚至立法否決的命令規章，仍然付諸實施。本文即從立法審查的角度，以行政命令的國會監督為主，試圖探討行政命令的法律屬性、類型與現實運作，剖析立法審查的理論機制，特別是立法審查的利弊，以及所面臨內、外環境的困境；包括違憲解釋權的擴張、立法審查的怠墮嚴重、及行政機關的怠忽國會。綜括而言，希望透過本文的研究，為立法審查的正常運作及發揮功能，提供解決問題與省思之途。

全文內容: 　　The functions of legislature were mainly on law-making, control and representation. As for nowadays, legislative supervision as well as control play a more importment role though other function fade out. During the period of martial-law, the executive branch inclined to ignore the legislative control and usually acted at it's discretion. The legislature, just for form's sake, didn't even own public support in spite of as a representative institution. As a result, officials of executive branch made much of regulations better than laws even it's not valid. Accordingly, this essay intends to discuss theory and practicality of the legislative censorship asserted on administratvie regulation, including the regulation's properties、categories as well as execution. The whole circumstances of impasse resulted from judicial explanation、excutive ignorance and legislative idleness itself will be examined and analyzed. Hope this is helpful and thus can lead correctly to solve the problem of concerns.
