立法院三讀通過臺鐵公司化設置條例,臺鐵正式轉型為公司化營運,同時設立董監事及安全管理委員會,交通部將設立基金處理臺鐵過去累積的短期債務。臺鐵公司化後,臺鐵公司由政府獨資經營,現職人員轉調至臺鐵公司並維持原勞動條件。本文旨在析論孫中山民生主義思想,與臺鐵公司化之核心理念。本文首先紹述孫中山民生主義思想之基本論述,包括平均地權、發達資本、振興實業、全民均富。其次,由臺鐵公司化過程,進一步歸納出,臺鐵公司化理念之核心要旨,概述公司化理論,分析臺鐵公司化之形式,與臺鐵公司化保留國營之要件,包括:臺鐵公司由政府獨資經營,轉調臺鐵公司之公務人員仍具公職身分。然後,作者析論孫中山民生主義思想,與臺鐵公司化理念核心要旨之關係。本文發現:臺鐵公司化理念與平均地權概念相符,臺鐵公司化理念與節制資本理念相容,臺鐵公司化理念與振興實業概念相合,臺鐵公司化理念與全民均富理念相通。

The Legislative Yuan passed the third reading of the Act for the Corporatization of Taiwan Railway Co., Ltd., officially transforming Taiwan Railway into a corporation. At the same time, director, supervisor, and safety management committees were formed, and the Ministry of Transportation and Communications allocated funds to handle Taiwan Railway’s previous short-term debts. Following Taiwan Railways’ corporatization, it became independently funded and operated by the government; the current employees were transferred to Taiwan Railways and their labor conditions were preserved. The purpose of this paper is to examine Dr. Sun Yat-sen’s Principle of the People’s Livelihood as well as the core concept of Taiwan Railway’s corporatization. First, it introduces the basic discourse of Dr. Sun Yat-sen’s Principle of the People’s Livelihood, which encompasses equal land rights, development capital, industrial revitalization, and equitable wealth for all. Second, it summarizes the process of Taiwan Railway’s corporatization, including the core idea of corporatization, an overview of corporatization theory, an analysis of the form of its corporatization, and the elements contributing to its state-owned retention. These elements include Taiwan Railways being independently funded and operated by the government and civil servants transferred to Taiwan Railways maintaining their government servant status. Next, the author analyzes the relationship between Dr. Sun Yat-sen’s Principle of the People’s Livelihood and the central concept of Taiwan Railway corporatization. On the basis of this research, it was discovered that the philosophy driving Taiwan Railway’s corporatization conforms with the principles of equal land rights, restricting private capital, industry revitalization, and equitable wealth for all.
