權力分立(Separation of powers)係當代憲法之重要原則。本文係以孫中山(1866-1925)先生的相關思想為對象。首先就孫中山有關政治分權理論的著(論)述進行研析,釐出其主要分權理論之內涵。其次,檢視前述憲政分權理論在中華民國憲法規範中的繼受情形。最後,探討這些憲政分權理論在當代憲政運作的情形,並嘗試提出筆者的觀察心得。
Separation of powers is the fundamental doctrine of constitution in modern constitutional democracy.
This paper first investigates the contents of Sun Yat-sen's Constitutional Theories of separation of powers by analyzing his scholarly works, followed by examining the role of separation of powers in the Constitution of the Republic of China. Third, the doctrine of separation of powers in constitutional practice will be discussed. Finally, some comments will be made.
